As a client one of your first questions is what will this cost? The mediator/attorney launches into a complicated explanation. The client interprets this as evasion. INCORRECT! The first thing to keep in mind is that the most expensive mediation is way, way, way less expensive than litigation. So keep that in mind.

The reason the mediator needs to “explain” his/her fee is because the cost depends on a number of factors. Consequently, the mediator must discuss this with the client(s) up front. I charge my clients my hourly fee for whatever work I put into mediating their divorce. I do not request a retainer up front as all attorneys do in a litigated case. My time is a function of how many meetings are necessary, telephone conversations with the clients and others, e.g., if it is necessary to retain someone to value a house or a pension, drafting the agreement, and drafting the divorce papers to be submitted to the Court. The clients are paying one fee, not two fees. My costs are a function of time and the level of complexity of your agreement. During my initial consultation with you, I am able to provide a good estimate of what your total costs will be.
